Terms of Service – Wrkout

1. Acceptance of Terms

By downloading, installing, or using the Wrkout application ("App") or accessing our website at wrkout.io ("Website"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, do not use our services.

These Terms constitute a legally binding agreement between you ("User," "you," or "your") and Wrkout ("we," "us," or "our").

2. Description of Service

Wrkout is a fitness and workout tracking platform that allows users to:

• Log and track workouts, exercises, sets, and repetitions
• Create and manage workout templates
• Track personal records and progress over time
• Connect with personal trainers for coaching and program management
• Access premium features through a paid subscription

3. Eligibility

You must be at least 16 years of age to use Wrkout. By using the App, you represent and warrant that you meet this age requirement. If you are under 18, you must have parental or guardian consent to use our services.

4. Account Registration

To use Wrkout, you must create an account using a valid email address. You are responsible for:

• Providing accurate and complete registration information
• Maintaining the confidentiality of your account credentials
• All activities that occur under your account
• Notifying us immediately of any unauthorized use of your account

We reserve the right to suspend or terminate accounts that violate these Terms.

5. Subscriptions and Payments

5.1 Free and Premium Tiers

Wrkout offers a free tier with limited features and a Premium subscription that unlocks additional functionality including unlimited workout templates, unlimited custom exercises, media uploads, AI-powered workout feedback, and advanced analytics.

5.2 Auto-Renewable Subscriptions

Wrkout Premium is available as an auto-renewable subscription with the following options:

• Monthly subscription: Billed monthly
• Yearly subscription: Billed annually

5.3 Billing

Payment will be charged to your Apple ID account at confirmation of purchase. Your subscription automatically renews unless auto-renew is turned off at least 24 hours before the end of the current billing period. Your account will be charged for renewal within 24 hours prior to the end of the current period at the same price.

5.4 Managing Subscriptions

You can manage and cancel your subscription at any time through your device's Settings > Apple ID > Subscriptions. Cancellation takes effect at the end of the current billing period. No refunds are provided for partial billing periods.

5.5 Price Changes

We reserve the right to change subscription prices. Any price change will take effect at your next renewal period, and you will be notified in advance.

6. User Content

You retain ownership of all content you create within Wrkout, including workout data, custom exercises, templates, notes, and uploaded media ("User Content").

By using the App, you grant us a limited, non-exclusive license to store, process, and display your User Content solely for the purpose of providing and improving our services.

You agree not to upload or share content that:

• Is unlawful, harmful, threatening, abusive, or harassing
• Infringes on the intellectual property rights of others
• Contains malicious code, viruses, or harmful software
• Is sexually explicit or pornographic
• Promotes discrimination, hatred, or violence

7. Trainer Services

Wrkout enables personal trainers to connect with and manage their clients through the platform. Trainers are independent service providers and are not employees or agents of Wrkout.

We do not guarantee the quality, safety, or suitability of any training advice or programs provided by trainers on the platform. Users engage with trainers at their own risk.

8. Health Disclaimer

Wrkout is a fitness tracking tool and does not provide medical advice. The App is not intended to diagnose, treat, cure, or prevent any disease or health condition.

You should consult with a qualified healthcare professional before beginning any exercise program, especially if you have pre-existing health conditions. You use the App and follow any workout programs at your own risk.

9. Intellectual Property

The Wrkout App, Website, brand, logo, design, and all associated intellectual property are owned by Wrkout and are protected by copyright, trademark, and other intellectual property laws.

You may not copy, modify, distribute, sell, or lease any part of our services or software, nor may you reverse engineer or attempt to extract the source code of our software.

10. Prohibited Conduct

You agree not to:

• Use the App for any unlawful purpose
• Attempt to gain unauthorized access to our systems or other users' accounts
• Interfere with or disrupt the integrity or performance of the App
• Use automated means (bots, scrapers) to access the service
• Impersonate another person or entity
• Circumvent any access restrictions or usage limits

11. Termination

You may terminate your account at any time by deleting your account through the App settings. We may suspend or terminate your account if you violate these Terms or engage in conduct that we determine to be harmful to other users or our services.

Upon termination, your right to use the App ceases immediately. Data deletion follows our Privacy Policy.

12. Limitation of Liability

To the maximum extent permitted by applicable law, Wrkout shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of data, loss of profits, or personal injury arising out of your use of the App.

Our total liability to you for any claims arising from your use of the App shall not exceed the amount you have paid to us in the twelve (12) months preceding the claim.

13. Disclaimer of Warranties

The App is provided "as is" and "as available" without warranties of any kind, either express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, and non-infringement.

We do not warrant that the App will be uninterrupted, error-free, or free of viruses or other harmful components.

14. Indemnification

You agree to indemnify and hold harmless Wrkout, its officers, directors, employees, and agents from any claims, damages, losses, liabilities, and expenses (including legal fees) arising out of your use of the App or violation of these Terms.

15. Changes to Terms

We may update these Terms from time to time. We will notify you of material changes by posting the updated Terms on our Website and updating the "Last Updated" date. Your continued use of the App after changes are posted constitutes acceptance of the updated Terms.

16. Governing Law

These Terms shall be governed by and construed in accordance with the laws of Norway, without regard to its conflict of law provisions.
